Welcome to Alarm Arcade ("App," "Service," "we," "our," or "us"). By downloading, installing, or using Alarm Arcade, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Alarm Arcade is operated by an independent individual developer.

1. Acceptance of Terms

By accessing or using Alarm Arcade, you agree to comply with and be bound by these Terms. These Terms apply to all users of the App, including users who access the App through the Apple App Store or any other distribution platform.

2. Description of Service

Alarm Arcade is an iOS application that provides:

Alarm functionality with customizable settings
Mini-games/challenges to dismiss alarms
Widget support for viewing next alarm and quick alarm creation
Optional Pro features available via in-app purchase

Core alarm features operate offline and store data locally on your device. Internet access may be required for in-app purchases and restoring purchases.

3. Eligibility

You must be at least 13 years old to use Alarm Arcade. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

4. Free and Pro Features

Free Features

Up to 5 alarms
Basic mini-games (Memory, Math, Shake, Tilt Maze)
Basic alarm sounds
Widget support

Pro Features (In-App Purchase)

Unlimited alarms
Additional mini-games (Reaction Grid, Simon Says, Typing, Swipe Pattern, Pattern Draw, Hold Timer)
Additional alarm sounds
All future Pro features

Important: Pro features are purchased through Apple's In-App Purchase system. Purchases are managed by Apple and subject to Apple's terms and conditions. We do not process payments directly.

5. In-App Purchases

Pro features are available as a one-time or subscription purchase (as determined by the App Store listing)
All purchases are processed by Apple, not by us
Refunds are subject to Apple's refund policy
Prices may vary by region and are subject to change
If you restore purchases on a new device, Pro features will be restored if you're signed in with the same Apple ID

6. User Responsibilities

You agree to:

Use the App only for lawful purposes
Not attempt to reverse engineer, decompile, or disassemble the App
Not use the App in any way that could damage, disable, or impair the App or interfere with other users' use
Not use automated systems to access the App
Maintain the security of your device and Apple ID
Use the App responsibly and not rely solely on it for critical wake-up needs

Disclaimer: Alarm Arcade is provided "as is" for entertainment and convenience purposes. We are not responsible for any consequences resulting from missed alarms, including but not limited to missed appointments, work, or other obligations. Always use backup alarm methods for important events.

7. Intellectual Property

Alarm Arcade, including its design, graphics, code, and content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or create derivative works of the App
Redistribute, sell, or sublicense the App
Remove or alter any copyright, trademark, or other proprietary notices

You retain ownership of any data you create within the App (alarms, settings, etc.).

8. Third-Party Services

The App may integrate with third-party services:

Apple App Store: For app distribution and in-app purchases
RevenueCat: For managing Pro feature entitlements
iOS System Services: Notifications, motion sensors, etc.

Your use of third-party services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or reliability of alarm functionality

We do not guarantee that alarms will always function correctly due to factors beyond our control (iOS system limitations, device settings, battery, etc.).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or use
Damages resulting from missed alarms or reliance on the App
Any damages exceeding the amount you paid for Pro features (if any)

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you violate these Terms.

You may stop using the App at any time by deleting it from your device. Upon termination, your local data will be deleted when you delete the App.

13. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will:

Update the "Last Updated" date at the top of this page
Notify users through the App or App Store listing (if required)

Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the courts located in Türkiye.

If you are located in the European Union, you may have additional rights under EU consumer protection laws.

15. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

These Terms are between you and us, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide support or maintenance
Apple is not responsible for any claims related to the App
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if applicable)
Apple and its subsidiaries are third-party beneficiaries of these Terms

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the use of Alarm Arcade and supersede all prior agreements and understandings.
